1.1 PERSONAL AND NON-PERSONAL DATA

Personal data (“Personal Data”) refers to information that identifies you as a specific individual, while non-personal data (“Non-Personal Data”) refers to information that does not identify you as a specific individual. Please note that at all times the Company will use the legal definition in effect to determine what Personal Data is and what it is not for the purpose of this Privacy Policy. When this Privacy Policy refers to “information” or “your information”, it could include both personal and non-personal data.

1.2 EXTENT OF THE PRIVACY POLICY OF THE COMPANY

This Privacy Policy covers only data we collect through the Web or through e-mail exchanges with the User, and no other data collection or processing, including, without limitation, the data collection practices of any partners or third parties, including third party operators of websites to which the Web links, and any information we collect online or through websites, products or services that do not display a direct link to this Privacy Policy.

On occasion, reference to this Privacy Policy may be made in notices on the Web, for example, on specific-purpose web pages, mobile applications or other resources, such as in the event that we invite you to submit ideas to improve the Web site. This Privacy Policy applies to information collected by us through such resources for special purposes, as modified in the specific notice (e.g., regarding the types of data collected, our uses, or disclosures of that information). The Company may amend this Privacy Policy at any time.

Any changes to this Privacy Policy will be effective on the “Last Updated” date above. By using the Site or providing us with information after such changes, you have agreed to the revised Privacy Policy. If the Company uses the personal data collected through the Web or emails exchanged with the User in a manner substantially different from that stated at the time of collection, the Company will notify users by email or by posting a notice on the Website for a period of 30 days prior to such use or by other means required by law

2. INFORMATION COLLECTED AND TIME OF STORAGE OF PERSONAL DATA

You provide different types of information so that the Company can offer and perform our services.

2.1 INFORMATION THAT THE USER PROVIDES TO THE COMPANY

We collect your data when you fill in any of the forms to hire the services offered by the Company through its Web, when you request information, participate in a survey, send us an evaluation or assessment, send us an e-mail, respond to our chat, upload contents or files, or, in general, when you actively send us data to the Web.

The data collected may include, among other things, your username and password for access to your Personal Area, first and last name, email address, telephone number (including cell phone number), mailing address, job, education, interests, and any other data included in a personal profile or resume. It also includes the documentation of applications and the answers to the questions that serve as a filter when hiring a service in the Company, as well as the answers that you have given to the questionnaires that have been sent to you and that have been answered.

2.1.1 Delivery of the Resume through Work Forms Service

One of the services we offer on the Web is the completion of the work forms that schools and educational associations and companies have on their websites.

In some of these work forms, additional information is requested from the User, which may not be in the documentation you initially sent us, and without which the work form cannot be completed. In these cases, the Company will send an email to the User requesting this information.

We are aware that the information requested on some of these work forms is excessive. That is why, if the User does not see fit to provide us with this additional information, we will proceed to cancel these specific forms that request this information and offer the User a refund of the amount paid for the forms that could not be completed.

Some of the extra data that could be requested, among others, in the work forms are the following:

Place of birth, Date of birth, Mailing Address, Number of children and/or economic dependents, Type of driving license and availability of own vehicle, Marital status, Telephone number, Social Security Number, Certificate of Disability, Current employment situation, Availability of mobility, Availability of employment, Reasons for wanting to work at the institution, Reasons for change of job, Economic pretension, Pillars that the candidate considers fundamental in education, Institution where the candidate did the teacher training, Tastes and preferences, or Academic training information.

By sending us any of these personal data, or others that do not appear in the above list, through an e-mail or through our contact form, the User accepts the Privacy Policy described in this document.

2.1.2 Delivery of the Resume through Post Mail Service

One of the services we offer on the Web is the delivery of the resume to schools and educational companies by mail.

When hiring the service of Delivery of the Resume through Post Mail, the User accepts that the letters that contain his personal documents (resume, cover letter, letters of recommendation, among others) are distributed by any post mail company.

2.1.3 Online Resume Creation Service

One of the services that we offer in the Web is the elaboration of the resume in HTML format (Online CV). The result is a web page of the type https://www.cvexpres.com/cvonline-3/maria-gomez-arias.

The Users’ Online CV will be stored in our databases for 2 years. Once this time has passed, the Company will send an email to the User in which he/she will be offered two options:

To request the hiring of the Update service. That way he/she will be able to keep the Online CV in our servers for another year, and also making any type of update of its content.

Requesting the elimination of the Online CV. In this case, we will proceed to eliminate from our servers the Online CV and any other personal data that we have of the User, including the e-mail. This process is irreversible.

2.1.4 Delivery of the Resume through E-mail Service

One of the services we offer on our website is delivering the resume to schools and educational companies by e-mail.

The e-mails used in the distribution of the User’s resume among schools and educational companies are public e-mails, obtained directly from their web pages. They are usually specific e-mails set up by schools and educational companies for the reception of spontaneous curriculum vitae, or otherwise generic e-mails.

The purpose of the Company in this service is to make the task of distributing the User’s resume among schools and educational companies easier. To do this, the e-mail structure is created, the addresses to which the email must be sent are provided and an email address is created on our servers from which the message can be sent. The User, when clicking on the “Validate” option in his personal area, is the one who makes the delivery.

2.1.5 Information received through your activity on the Web

As part of the rules of operation of the Web, The Company may collect and analyze information from your computer or mobile device and actions taken on the Web, including: the time spent on the Web and on each page, the pages you visit, the clicks made, the session activity, the browser type, the operating system, the device type, the MAC address, the IP address and the name of the domain from which you access the Web.

2.2 STORING YOUR INFORMATION

The Company shall keep the User’s personal data to the extent that this storage is adequate and relevant, being limited to what is necessary for the purposes for which it is processed. In particular, the Company shall not keep personal data for longer than necessary for the purpose of performing the processing described in this Privacy Policy.

The resume, cover letter and other personal data received by the Company from the User shall be kept in our databases for 2 years. It will be kept during this period in order to make it easier for the User to hire new services on our Web, so that the User does not have to send us all his documentation again. Once the period of 2 years has passed, all personal data will be irreversibly deleted.

During the time in which we have the personal data of the User (2 years), the Company guarantees that it will not be used for anything more than to carry out the services hired by the User in our Web or for the development of future contracts that the User carries out in our Web.

The User may at any time exercise his right to the immediate removal of any personal data that we keep in our database by requesting it through:

  • Our contact form.
  • Through the e-mail teacher@cvexpress.com.
  • Through the “Privacy” option that you can find in your Personal Area.

2.2.1 Storage of the e-mail

Regarding the time of storage of the User’s personal data, an exception will be made with the e-mail, because it is necessary to keep it longer for the calculation of the discounts offered to the User when he hires the services more than once. The e-mail and name of the User will be kept for 4 years. Once the 4-year period has passed both will be irreversibly deleted.

The Company guarantees that under no circumstances will the e-mails stored in its database be used for advertising, marketing or promotion of its products or services or of third parties. Its use will be limited to the services hired by the User on our Web, or to the calculation of the discounts that the Company offers the User when he/she hires the services more than once.

The User may at any time exercise his/her right to immediate removal as set out above.

2.2.2 Storage of Online CV

Users’ Online CVs will be stored in our databases for 2 years. Once this time has passed, the Company will send an email to the User in which he/she will be offered two options:

Requesting the hiring of the Update service. That way he/she will be able to keep the Online CV in our servers for another year and making any type of update of its content.

Requesting the elimination of the Online CV, and in this case, we will proceed to eliminate from our servers the Online CV and any other personal data that we have of the User, including the e-mail. This process is irreversible.

The User may at any time exercise his or her right to ask for its immediate removal as set out above.

2.3 LEGAL BASIS ACCORDING TO WHICH THE COMPANY COLLECTS YOUR PERSONAL DATA

The Company collects and processes the User’s personal data on different legal bases, depending on the type of personal data provided and the type of processing involved:

2.3.1 Execution of a contract

The processing of most personal data by the Company is carried out on the premise that it is necessary for the execution of our contract with you, or to take the necessary measures at the User’s request before signing said agreement

2.3.2 Compliance with a legal obligation

For some types of processing, another rationale is that it is necessary to enable the Company to meet a legal obligation. An example of this would be when the Company is required to retain business records for fixed periods to meet local legal obligations.

2.3.3 Consent

Finally, in some situations, the Company depends on your consent to process your personal data. When the Company needs your consent to collect and process certain personal data, we will ask for it at the time of provision, and this processing will only take place when consent is secured. For example, your consent will be requested when you hire the service of resume delivery to educational institutions and companies.

3. LIMITATION OF USE OR DISCLOSURE OF PERSONAL DATA

3.1 WHEN THE USER REQUESTS THE REMOVAL OF HIS PERSONAL DATA

The User may at any time exercise his right to the immediate removal of any personal data that we keep in our database by requesting it through:

  • Our contact form.
  • Through the e-mail teacher@cvexpress.com.
  • Through the “Privacy” option that you can find in your Personal Area.

If the User deletes all personal data by any of these 3 options, he will no longer have access to the Personal Area and to any existing information in it, such as the lists of schools to which the resume has been send or the answers received from schools. If the User uses the same email address to create new hires, thus having access again to a new personal area, the existing data in the previous personal area will not be available to the User.

The discounts that apply to second, third or fourth hires cannot be applied either, since we will not have any information about previous hires made by the User.

The fact that a User requests the removal of his/her personal data means that all data will be irreversibly deleted from The Company’s systems.

3.2 NECESSARY PERSONAL DATA

When providing the service, the Company will indicate whether it needs specific personal data to perform certain services. If the necessary personal data is not provided, the specific service may not be available to you.

3.3 MINIMUM AGE OF OUR USERS

The Company limits the processing of personal data to Users who are of legal working age and takes a series of measures to try to ensure that Users who do not meet this requirement are not accepted.

4. PURPOSES, USES AND DISCLOSURES OF INFORMATION

The Company manages the personal data of the Users with the following purpose:

  • To be able to carry out the services that the client has hired, as well as their maintenance and follow-up.
  • To be able to maintain contact with the User, to process and manage the hired services and to be able to respond to any incident or query from the customer (either via e-mail, chat, SMS, contact form or telephone).
  • To be able to manage and give access to the User’s Personal Area.

4.1. DELIVERY OF THE RESUME TO SCHOOLS AND EDUCATIONAL COMPANIES SERVICE

When hiring the services of Delivery of the Resume by e-mail, post, or web forms, through any of the Hiring Forms existing on the Web, the User expressly authorizes the Company to transfer all personal data to those schools and companies whose characteristics match those selected by the User in the Hiring Form, and in order to carry out the necessary purposes of the hired service.

The User waives any legal action against the Company in relation to the transfer of his/her personal data to schools and educational companies (resume, cover letter, email, telephone, etc.), since it is the User himself/herself who expressly authorizes the transfer of his/her personal data to schools and educational companies whose characteristics match those selected in the Contract Form.

Delivering the Resume through the Postal Service.

When hiring the service of Delivery of the Resume through Postal Mail, the User accepts that the letters containing his personal files (resume, cover letter, recommendation letters, among others) will be distributed by the post company.

4.2 DELIVERY OF PROMOTIONAL AND ADVERTISING MATERIAL

The Company guarantees that the e-mails stored in its databases, or other contact information provided by the User, will not be used under any circumstances for advertising, marketing or promotion of its products or services, or of third parties.

4.3 CONTACT INFORMATION

The User, by providing his/her contact information (such as name, email or telephone number) to the Company, in addition to other personal and non-personal data, agrees that the Company may use this information for the purposes described above, as appropriate. Specifically, the User agrees that the Company may, as part of the services provided to him/her, communicate with him/her via email, phone (including cell phone), SMS or mail, including other means, by using the contact information that the User has provided to the Company.

We may use multiple methods to detect and address anomalous activity and to select content to prevent misuse such as spam and fraud. However, these detection methods are not perfect and false positives may occur. On occasion, such efforts may cause a temporary or permanent suspension or termination of some functions for some Users.

Fraud and Spam Prevention in Messages

The Company also reserves the right to discard messages and emails that it believes do not adhere to the rules of the Web or any of the terms of this agreement. In addition, the Company reserves the right to conduct investigations to decide whether you are committing a scam, sending spam to the Company or User, or are conducting fraudulent activities on the Company through different means, including investigating its operation by creating profiles and names that belong to the Company. The Company also reserves the right to turn over to the police or third parties the information obtained through such investigations if the Company believes in good faith that you are using the Web in breach of these terms.

  • By bank card, using the Stripe payment platform

When the User makes the purchase of a service on the Web through the Stripe payment platform, all credit card details, which must be entered to complete the payment, are sent directly to Stripe.
